On October 9, 2024, the High Tech Law Institute at Santa Clara Law had the privilege of hosting a panel of judges from the U.S. Court of Appeals for the Federal Circuit. Judges Todd M. Hughes, Timothy B. Dyk, and Tiffany P. Cunningham convened in Santa Clara Law’s Panelli Courtroom to hear arguments in cases involving patent litigation, employment retaliation, and veterans’ benefits. The judges’ incisive questioning illuminated key legal issues, guiding potential rulings that could have wide-reaching impact.
After the session, students engaged in a Q&A with the judges. Santa Clara Law students were eager to learn how the judges prepare for hearings, what they prioritize in written briefs and oral arguments, and how they approach making difficult decisions. During the discussion, each judge shared personal stories about their paths to the bench and offered insights into the judicial career track.
Judge Hughes encouraged prospective clerks to consider judicial clerkships regardless of their experience level, noting that even attorneys who have practiced for a few years are welcome to apply. This flexibility opens the door for seasoned attorneys who seek to deepen their understanding of appellate law through clerkship experience.
Judge Cunningham explained that she pays close attention to the questions posed by her fellow judges, as their inquiries often reveal different perspectives and guide her own approach during oral arguments. She also emphasized to students the importance of directly answering judges’ questions, advising that clear and responsive answers can strengthen their arguments and help them engage more effectively with the court.
The judges’ clerks also shared their personal journeys to the Federal Circuit. They described the unique opportunities that judicial clerkships offer, from exposure to high-stakes cases to the intensive experience of drafting bench memos.
Following the Q&A, a luncheon provided the students with the rare opportunity to interact informally with the judges and their clerks. The judges took time to acknowledge the students’ enthusiasm, thoughtful questions, respectful engagement, and professional attire. The judges and their staff also commended the High Tech Law Institute’s team for their seamless coordination and hard work in organizing every detail of the day.
