Course Description:
Introduction to the procedure for the enforcement of criminal law dealing with police investigations (including searches and seizures under the Fourth Amendment) the issuance and execution of search warrants, the laws of arrest (including arrest warrants), stop and frisk policies, police interrogations (and the right to counsel/right against self-incrimination that attaches during custodial investigations), and the admissibility (vel non) of statements and evidence taken in violation of the Fourth and Fifth Amendments. This course covers the large bulk of Criminal Procedure issues presented on the Bar Examination. Students will become familiar with the leading Supreme Court cases on the subject. Bar Course. Santa Clara Law offers two courses relating to criminal investigations. Criminal Procedure: Investigation is related to Criminal Procedure: Adjudication, but neither course is a prerequisite for the other. Students may take both Criminal Procedure: Investigation and Criminal Procedure: Adjudication.
