Professor Michael Asimow’s new book Federal Administrative Adjudication Outside the Administrative Procedure Act has just been published by the Administrative Conference of the United States. The book focuses on evidentiary hearings conducted by federal agencies that are not covered by the federal APA. These include veterans’ benefits, immigration, government contracts, environmental appeals, protection of government employees from discharge without good cause and against illegal discrimination, and numerous others. Adjudication before these agencies is governed by their procedural regulations that confer about as much procedural protection and as much formality as in APA adjudication. The book suggests best practices for these non-APA evidentiary hearings and for true informal adjudication.
