The Datta Center for High Tech Law is pleased to welcome Professor Erika M. Douglas to Santa Clara University School of Law and to our distinguished High Tech Law faculty community.

Professor Douglas is an Associate Professor at Santa Clara Law and co-supervisor of the Privacy Law Certificate with Professor Eric Goldman. Her scholarship focuses on the intersection of antitrust, data privacy, and technology regulation.

Before joining Santa Clara Law, Professor Douglas was an Associate Professor at Temple University, Beasley School of Law. Prior to that, she practiced antitrust law in the Silicon Valley office of Covington & Burling LLP, where she represented Fortune 100 technology companies in complex antitrust matters and investigations.  

Professor Douglas is an accomplished scholar whose work has been recognized nationally. She was recently awarded the Jerry S. Cohen Award for Antitrust Scholarship, Best Publication of 2025 on Antitrust in Regulated Industries for her article Antitrust Abandonment. Her work appears in leading publications including the Yale Law Journal Forum, Harvard Journal of Law & Technology and Virginia Journal of Law & Technology, and explores a range of issues at the intersection of technology, antitrust, and privacy. Her recent work includes M&A Exceptionalism in Privacy Law, examining the failure of U.S. privacy law to apply to mergers and acquisitions.She is also joining as a co-author of the sixth edition of Antitrust Law in Perspective: Cases, Concepts and Problems in Competition Policy. 

In addition to her scholarly work, Professor Douglas serves in leadership roles with the American Bar Association Antitrust Section, the American Antitrust Institute, the Association of American Law Schools Section of Antitrust and Economic Regulation, and internationally on the C.D. Howe Institute Competition Policy Council. She is also a Fellow of the Yale School of Management Thurman Arnold Project.

Professor Douglas holds an LL.M. in Law, Science and Technology from Stanford University, as well as a J.D. and Honors in Business Administration from the University of Western Ontario. She teaches Antitrust, Privacy, Patents, New Technology Regulation, and Contracts.
