Marc Eisenhart
Marc brings over a dozen years of legal experience representing individuals and companies in the areas of employment litigation and business litigation. He provides additional legal services that include landlord-tenant, real estate litigation, commercial disputes, contracts, and criminal defense.
“I'm not afraid to try a case and I am very comfortable in front of a jury,” Marc says. He has won the largest jury verdict in the history of Santa Clara County for unlawful retaliation by a residential landlord. He also won a multi-million dollar fraud verdict arising out of a real estate construction dispute.
Marc's record of defending businesses includes a winning summary judgment on behalf of corporate officers and directors sued for millions of dollars for fraud and breach of contract. Recently, Marc successfully defended business owners from eviction, thereby preserving their multi-million dollar ground lease.
Businesses regularly turn to Marc for guidance and counseling in the areas of lawsuit mitigation, drafting employee and management handbooks and anti-discrimination policies, conducting regular anti-discrimination training, and auditing wage hour and overtime practices.
Marc assists the San Jose Pro Bono Project in their H.E.L.P. Division (Homelessness Prevention Eviction Law Project), and he is a regular lecturer for the Apartment Owners Association—a National Landlord Association (www.aoausa.com), speaking to audiences of landlords and property managers.
Admitted to practice in California and before the United States District Court, Northern District, Marc has served as Judge Pro Tem and Judicial Arbitrator for the Santa Clara County Superior Court.
