This is a reminder that today, August 21, is the payment deadline for any remaining fall charges that have not yet been paid.
Please note that all accounts with unpaid balances will incur an additional $75 late fee and hold preventing waitlist registration and schedule changes.
Payment can be made online with an electronic check (free of charge) or by using a credit card which does include a non-refundable service charge of 2.75%.
To verify your current account balance via eCampus, go to Student Center >>> Finances >>> Account OR SCU Account Detail and your entire account history will appear. Please note that this screen will not reflect any anticipated aid that has not yet disbursed into your account. You will need to review your billing statement to verify that information. Clicking on Financail Aid link will show your Financial Aid award summary.
If making payment at the Bursar Office counter and you have a financial hold, please be prepared to pay with guaranteed funds (certified check or cash) if your balance is over $1000.
Financial holds will be removed within 24 business hours of your payment posting to your account, so the sooner you make your payment.......the better. Online payments will post on the next business day to your student account.

This is a reminder that financial clearance is tomorrow, July 21.
If you are currently enrolled in classes you will need to pay your tuition by the end of the day tomorrow.
For your information undergraduate students will be actively registering during the day and that will slow down the system so please plan accordingly. Keep in mind that if you wait until the last minute you may not be able to make your payment and you will be assessed a $75 late payment fee.

Parking Lot Repairs this Week

We are expecting a paving contractor to be on site either Wednesday or Thursday of this week to make repairs in the following parking lots. I cannot confirm which day they will be here at this time.
University Finance Office--areas to be repaired are outlined on the pavement in orange. They are in the entry aisle and in the aisle along the south side of the lot. Please do not park in these areas; and use the entrance off Benton which leads to the driveway at the back of your building to avoid any conflicts;
Leavey Lot: the areas to be repaired are primarily at the north end of the lot. It is recommended that cars enter the lot from Accolti way while repairs are in progress;
South Bannan Lot: The area around an underground vault at the west end of the first row of parking spaces (closest to Bannan Hall) needs to be repaired. When the work is in progress, cars will not be able to exit the lot, so this row of stalls will be closed to vehicles on Wednesday (and Thursday) if necessary. Signs/Barricades will be in place at Sherman St blocking access to these stalls temporarily.
Each of these lots will be closed to all vehicles during pavement resealing and re-striping in the near future. We will notify you well in advance of when this work will occur.

Regarding: New disk-less exam procedure (FlexSite)
Hope all of you are having a good summer. I wanted to inform you that we are once again re-introducing FlexSite, the disk-less, internet based exam delivery system from ExamSoft. If you took summer classes last year, then you were able to experience this system in its early stages. We have made several modifications to improve performance and reliability of this product. We will use this system for all (unless they are only multiple-choice) exams starting summer 2006. I have outlined below some key items that need to be completed in order for you to take your exam on your laptop. If you do not follow these steps, then your computer will not have the ability to run FlexSite and you will be asked to write your exam responses. Please e-mail me if you have any questions or concerns. The first step asks you to download the new FlexSite version of Softest. You should have received this e-mail already. The e-mail contained your log-in and password. Unless you are a new student this summer, you will use the same log-in and password you have used in past semesters.
*PLEASE MAKE SURE YOU KNOW YOUR 4-DIGIT BLIND GRADING ID BEFORE TEST DAY. YOU WILL NEED THIS NUMBER FOR ALL TEST MATERIALS. Also, you will need a network cable on exam day in order to obtain an internet connection.
I. ExamSoft Login & SofTest Registration Instructions
Logging In & Installing SofTest
- Visit your Custom Home Page: www.examsoft.com/sculaw
- Click the “Exam Takers” tab at the bottom of the page
- Log in using the Student ID & Password that you used last semester.
- Download SofTest – ALL students will need to download this version due to the switch to FlexSite.
SofTest Registration
You can now register SofTest:
- If your computer prompts you to reboot:
- Click “Cancel”
- On the “Complete Registration” window, enter your Student ID and password then click “Register”
- Reboot your computer once you are notified that registration is complete
- If your computer DOES NOT prompt you to reboot:
- On the “Complete Registration” window, enter your Student ID and password then click “Register”
- You will be notified that registration is complete
Upon Registration Completion
You should receive a message window, and later an email message, confirming registration. By double-clicking the “SofTest” icon, you can download an exam file (once your institution/instructor advises you to do so) and take a Practice Exam or a real exam by clicking the "Launch SofTest" button. To take a Practice exam, click the “Practice Exam” button.
II. Download & Upload SofTest Exam File Instructions
Your exam files will be ready to download on Friday, July 14, 2006. You should receive a message from ExamSoft telling you how to download the exam files. If for some reason you do not receive the message or you lose the e-mail, below are the detailed steps for you to follow. Please make sure you have downloaded your exam file before the day of the exam. Please remember that you need to download a new version of SofTest (this summer) before you can execute the following steps.
Download Exam Files
- Connect to the Internet
- Double-click the “SofTest” icon on your Windows Desktop. The “SofTest Launcher” window should appear.
- Click the “Download Exam Files” button
- Enter your “ID” and “Password” then click “Next”.
- If the Download Password screen appears, click “Next”, there is NO password required to download the exam file.
- Select an exam from the list and click “Download”. If there is a second exam in the list, do the same. When you have downloaded your exam file(s), click “Close”.
- Click the ’Exit’ button.
Take an Exam
- Double-click the “SofTest” icon on your Windows Desktop.
- Click the “Launch SofTest” button. SofTest will load.
- Select your exam from the Exam File drop-down list.
- Complete all required fields (marked with a red asterisk) and click “Begin Exam” to start the exam.
- Your computer will reboot into Secure Mode. When the proctor has instructed you please type “Begin” then click the ’begin’.
- To exit the exam, click ’File’ then ’Save and Exit’. Click “Close Exam” when prompted and on the yellow screen, click “Exit”.
- Your computer will reboot into Windows.
Upload Answer Files
- Once your computer reboots, SofTest will look for an internet connection. If connected to the Internet, SofTest automatically uploads your answer file(s). You should receive a prompt that tells you your exam files have been uploaded successfully.
- If not connected to the Internet-
- To upload NOW, connect to the Internet and click “Yes” when prompted to upload.
Upload Confirmation
ExamSoft provides two methods of verifying that your answer file uploaded:
- You will be emailed confirmation that your answer file uploaded.
- Log in to the Exam Takers section of the website and select ’Exam History’.

Details of the Analytical Writing Graduation Requirement

Supervised Analytical Writing Requirement
Academic Affairs Committee Adopted May 5, 2006
Each student at Santa Clara University School of Law must satisfy a Supervised Analytical Writing Requirement as a condition of graduation. The Requirement is intended to assure that each student completes a significant piece of legal writing under the supervision of a faculty member following the first year of law school. The Supervised Analytical Writing Requirement is in effect for matriculating students who began Law School in fall 2005. It is the responsibility of each student to satisfy this Requirement before graduation from Law School.
General Goals and Objectives
The ability to write effectively and persuasively is fundamental to law practice. A lawyer’s service to society and professional satisfaction depend on an ability to communicate through writing. The purpose of the Supervised Analytical Writing Requirement is to further develop and improve that ability in each student beyond the level achieved in the first year research and writing program and the second year Advocacy course. In addition, the writing experience will provide the opportunity for intellectual growth through concentration and analysis in a specialized area of law.
How the Requirement Can Be Satisfied
The Supervised Analytical Writing Requirement can be satisfied only by individual work; joint papers or projects do not qualify. Students may discuss topics, ideas, or other aspects of the writing project with others, and may exchange drafts for the purpose of seeking feedback on improving the writing; however, all of the research and writing must be exclusively the student’s own work. In general, students may not use a writing that satisfies another requirement of graduation—such as an Advocacy brief or a brief produced in connection with a course satisfying the Skills Requirement¾for the Supervised Analytical Writing Requirement. However, a paper that satisfies the Supervised Analytical Writing Requirement can also satisfy the paper requirement for one of the specialized certificates (e.g., International Law, High Tech, or Social Justice). In addition, a paper completed in connection with a course that satisfies the Skills Requirement may satisfy the Supervised Analytical Writing Requirement if the skills course involves substantial instruction in a professional skill other than brief writing (such as negotiation, interviewing, or oral advocacy). Faculty will certify that any writing produced in connection with the Skills Requirement does not also satisfy the skills component of the course (e.g., if the skills component involves the drafting of a brief, contract, or license).
So long as the paper meets the criteria set forth in the next section, the Supervised Analytical Writing Requirement may be satisfied in one of the following ways:
(1) A paper required in a course or seminar in which the student is enrolled. Papers written for seminar credit must independently satisfy the criteria for the Supervised Analytical Writing Requirement as set forth below. Not all papers that are satisfactory for course credit will be satisfactory for the Requirement.
(2) A law review comment or note written for one of the LawSchool’s law reviews. A faculty member must review the student’s comment or note and determine whether it meets the criteria for the Supervised Analytical Writing Requirement. A revision may be required.
(3) Independent research (Course 350).
(4) Upper division writing course. A paper or series of shorter papers produced in an upper division writing course will satisfy the Supervised Analytical Writing Requirement if the instructor determines that the criteria specified below are met.
(5) A directed research and writing project without credit.
(6) Moot Court Brief. Normally, a brief or memorial (“brief”) submitted in the context of a moot court competition would not satisfy the Supervised Analytical Writing Requirement as such writings are usually collaborative exercises and are not produced with faculty supervision. However, if a student is the sole author of a brief, or a significant portion of a brief such as a substantial section or argument contained within a brief, such a brief or portion thereof may qualify. Students who want to satisfy the Supervised Analytical Writing Requirement through a Moot Court competition may do so by resubmitting their brief to the faculty advisor or another faculty member after submission in the competition. If the student wishes a portion of the brief to satisfy the Requirement, the student must identify the portion of the brief for which he or she is the sole author. The faculty member will review and critique the brief with the student and will likely require revision of portions of the brief, or brief section, prior to certifying the brief as meeting the Supervised Analytical Writing Requirement.
Supervised Analytical Writing Requirement Criteria
Regardless of the way in which the student chooses to satisfy the Requirement, the final product must meet the professional standards and expectations for the relevant audience. Close and critical faculty supervision and review of the writing is expected. The topic shall be selected early in the term. Next, the student should, inter alia, develop a research strategy, produce an outline, formulate a thesis as appropriate, submit a first draft, engage in faculty consultation, implement revisions, and submit a final draft. If the final product is not satisfactory, the faculty member may deny approval or may require that the paper be rewritten again before certifying that the Supervised Analytical Writing Requirement has been met.
The student’s final product should demonstrate an ability to analyze complex legal issues and to communicate the analysis effectively. The writing is expected to be of high quality. The faculty member will approve the writing if it demonstrates the following qualities:
• the choice of an original or challenging topic;
• the succinct articulation and support of the thesis, if applicable;
• logical organization;
• an appropriate level of research and analysis;
• comprehensive analysis of the relevant law and application to the topic;
• persuasiveness and analytical depth, as appropriate;
• a proper introduction and conclusion;
• clear, concise, direct sentences;
• proper paragraphing and appropriate use of headings, sub-headings, and transitions;
• the correct use of legal terms and citation forms;
• appropriate attribution to original and secondary sources as necessary;
• adherence to the prohibition against plagiarism;
• proper grammar, syntax, punctuation, spelling and capitalization; and
• a neat and professional appearance.
Although the required page length will depend upon the nature of the project and the number of units sought, rarely would a piece of writing of fewer than twenty pages be adequate to satisfy the Requirement.
Formal Procedures
Any member of the full-time faculty may supervise the writing and certify that it meets the Supervised Analytical Writing Requirement. LARAW professors, visiting full-time professors, and teaching scholars or fellows, and lecturers teaching an upper division writing course may also supervise a paper for the Supervised Analytical Writing Requirement. Under certain limited circumstances, the Associate Dean for Academic Affairs may approve certification by part-time or adjunct faculty, such as where the student desires to write on an area of particular expertise of one of our lecturers. Upon receiving a written petition from a student to allow for such supervision setting forth reasons for which the paper should be supervised by a lecturer rather than a full faculty member, the Associate Dean will consult with the lecturer to explain that such supervision is not expected and to convey the time commitment and degree of rigor expected for the supervision.
A student’s first choice of supervisor may not be available if the particular faculty member is already supervising, or has already supervised, a sufficient number of papers pursuant to the Requirement.
When the student has chosen the way by which s/he intends to satisfy the Supervised Analytical Writing Requirement, a “Writing Agreement” must be completed with the supervising faculty member and filed with Law Records at the outset of the project. This Agreement should reflect the means by which the student intends to fulfill the Requirement (by a seminar paper, independent research, etc.) and an estimated completion date. The Agreement must be signed by both the student and the supervising faculty member. Upon final completion of the paper and approval by the supervising faculty member, the faculty member shall certify on the Agreement that the Supervised Analytical Writing Requirement has been satisfied. The completed Agreement and a copy of the paper must then be submitted to Law Records for inclusion in the student’s file for graduation.

There are openings for the summer semester. The course is being offered in the evening.
The Northern California Innocence Project is a clinical law course that provides law students the opportunity to represent California prisoners raising claims of factual innocence.
At NCIP, law students are closely supervised by experienced attorneys and forensic experts. They review trial and appellate briefs, transcripts of testimony, forensic reports, crime lab evidence and conduct factual investigation. Students are also part of the legal team at hearings on petitions for DNA testing and writ of habeas corpus.

The Sixth District Court of Appeal will be sitting in our moot court room on Tuesday, April 11, 2006 from 9:30 a.m. - 12:30 p.m. Students are invited and encouraged to sit in to watch the Court at work. Summaries of the cases will be available in the courtroom.
Once again, officials charged with security have requested that no animals be brought into Bergin Hall on that day. This request is to avoid possible disruption in the halls outside the courtroom during the proceedings.
Please keep in mind that everyone entering the courtroom will be asked to leave all backpacks and packages outside the courtroom and will go through a minimal security screeening process.

Law Admissions Is Seeking Summer Counselors for the PLUS Program

Interested in working with prospective law students from a variety of backgrounds over the summer? Want to earn some money over the summer? Then apply to be a summer counselor for the PreLaw Undergraduate Scholars (PLUS) program.
The PLUS Program at Santa Clara University is one of only a few similar programs in the entire country sponsored by the Law School Admission Council. The four week program is meant to better prepare students from disadvantaged backgrounds to the realities of law school and help them to be more competitive law school applicants. Students stay in the dorms on campus along with law student mentors, eat meals in the Benson Center, attend daily classes and workshops taught by law faculty and staff, participate in special events on campus, and go on trips to other law schools and court facilities.

Moot Court Teams Compete at Trademark Competition

Congratulations to SCU Law School External Moot Court Team members Kim-Lien Dang, Sriranga Veeraraghavan, Amanda Gardner and Matt Williams! The two teams competed recently at the West Coast Regional Rounds for the 15th Annual Saul Lefkowitz Moot Court Competition. The Competition was established in 1990 by the Brand Names Education Foundation in honor of Saul Lefkowitz, a Chairman of the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office. Now sponsored by the International Trademark Association, the Competition is an annual event consisting of Regional Competitions in Atlanta, Chicago, New York and San Francisco, and a Final National Competition in Washington, DC, USA. The West Coast Rounds were hosted by Townsend and Townsend and Crew LLP.
The West Coast Rounds were held Saturday, February 25, 2006, at the 9th Circuit Court of Appeals in San Francisco; both Santa Clara University Law School teams competed well, each facing two teams from among the field of 20 from various West Coast law schools. The team members were coached by Adjunct Faculty members Colby Springer and Karin Carter, both of whom are also local practicing attorneys. The teams were accompanied to the West Coast Rounds by Ms. Carter. Congratulations to both SCU Law School teams for a job well done!!

Subject: Outstanding Graduate
For the past couple of years, the School of Law has named the outstanding graduate from the graduating class. The proceeds from a $100,000 gift from an alumnus permits an award of $5,000 each year to the graduating student so selected. This award will be made again this year and I am writing to encourage your assistance in recognizing the outstanding graduate of the Class of 2006.
A key element in the selection process is through members of the faculty nominating students. A committee reviews the faculty nominees and ultimately selects the recipient from the nominees. Students and staff are encouraged to identify and nominate worthy students to members of the faculty. Faculty, in turn, will submit their nominees to the committee. Faculty members may nominate more than one student.
Criteria established by the donor for selection are: member of the graduating class; scholarship that includes not only grades, but also scholarly activity such as work on scholarly journals, moot court success, and performance in seminars; leadership roles held while in school, and other professional service and accomplishments, such student organization leadership, and pro bono work In short, while academic achievement is an important criteria, the award is designed to recognize the "complete student," not just the one with the highest grades.
As final nominations need to be in the dean’s office no later than March 17, you should submit your suggestions to a faculty member soon. Thank you for taking part in the process. Please consider nominating one or more graduating students for this prestigious award.

The two teams competed this past weekend at the ABA sponsored National Appellate Advocacy Competition, one of the largest competitions in the nation. Oanh, Paola and Jaclyn advanced to the semi-final round which was held on Saturday afternoon at the 9th Circuit Court of Appeals in San Francisco. Although the team did not advance to the final round, they made a strong showing for SCU Law. The team members were accompanied by Coach Prof. Angelo Ancheta, and bailiff, Justin Miyai. Again, congratulations for making it so far in the competition!
Pace Law School 2006 Int'l Criminal Court Moot Competition - Nov 10-12, 2006

In Fall 2006, Santa Clara will again field a team to compete in the Pace Law School International Criminal Court competition. Last year, our team ranked third and won several individual accolades. Students with an interest in international and criminal law in particular should consider trying out for the team. Details about the try outs will be circulated soon.
Try outs will coincide with try outs for the Jessup International Law Moot Court team as well. This year, our team made it to the regional finals, losing narrowly to the University of Texas who will go on to compete in the world championships.

INTERNATIONAL CRIMINAL COURT MOOT COMPETITION
THE INVITATION
Pace Law School is proud to announce the second annual International Criminal Court Moot Competition November 10-12, 2006. The event is open to the international law school community, welcoming law schools from disparate legal traditions to compete against one another in the context of a hypothetical criminal trial to be argued before the International Criminal Court.
THE COMPETITION IN BRIEF
Each team will submit three short memorials (briefs) requiring the students to research and develop arguments based on the three participants in ICC prosecutions, i.e., the Prosecution, the Defense and the Victims’ Advocates, a new role developed for the first time for the International Criminal Court. These memorials will be evaluated by legal scholars, and prizes will be awarded for best brief, second place runner-up, and third place runner-up in each of the three categories of memorials. Rules for participation by team coaches in the brief writing and oral argument phases of preparation are available on our web site.
Perhaps the most exciting feature of the Moot, and one unique to this competition, is that each team of students will participate in three rounds of oral arguments and have the opportunity of arguing from all three perspectives, prosecutor, defense counsel and victims’ advocate. Students who participated in a trial run for the Moot last year all commented that they had never experienced a better way of learning the substantive and procedural law in a given area and fully developing the arguments of the parties than by having the opportunity to make those arguments from all three perspectives during the Moot.
The 1st ICC Moot Competition featured a dinner reception and keynote address by Prof. David Scheffer, former Ambassador-at-Large for War Crimes in the Clinton Administration and chief negotiator for the United States on the Rome Statute. The final round of oral arguments was judged by leading experts in the field of international criminal law and the ICC. Dr. Benjamin Ferencz served as the Chief Judge on the panel for the Final Round.

Legendary San Francisco trial lawyer James Brosnahan will be on campus at Santa Clara from 4:00 p.m. to 5:15 p.m. on Thursday, Feb. 23, to present a lecture on tactics for jury selection. The lecture will be open for all Santa Clara law students to attend, in Bannan Hall 139. Mr. Brosnahan was lead counsel for Jon Walker Lindh, as well as Oakland Raiders case, Marcus Williams v. William Romanowsky.
James J. Brosnahan is one of the nation’s most respected and recognized trial lawyers, with expertise in both civil and criminal trial work. He was inducted into The State Bar of California’s "Trial Lawyers Hall of Fame" in April 1996; was awarded the "Samuel E. Gates Award" by the American College of Trial Lawyers in October 2000: was named the "Trial Lawyer of the Year" by the American Board of Trial Advocates in October 2001; was named "Legend of the Law" by the Laywer’s Club of San Francisco, November 2002; and was awarded the William J. Brennan Jr. Award from the University of Virginia Trial Advocacy Program, January 2003.

"I have recently agreed to serve the California Commission on the Fair Administration of Justice as Executive Director, while continuing my teaching responsibilities here at the law school. The Commission will establish an office very close to campus, and I have been authorized to hire an Executive Assistant to direct office operations. This will be a full-time position, at an annual salary of $45,000 plus benefits, for a two year term. I think it would be an ideal position for a part-time student, both because of the proximity of location and the nature of the work. The Commission is undertaking a broad examination of the causes of wrongful convictions in California, and will recommend appropriate reforms to the legislature and judicial council. The Commission is chaired by John Van de Kamp, and the Commission members include the Attorney General, Police Chiefs, District Attorneys, Public Defenders and Judges, as well as other lawyers engaged in criminal defense and prosecution. Strong skills in office management and computer use are needed, as well as strong motivation to work for justice reform. Each year, the Heafey Center invites an outstanding trial or appellate lawyer to visit campus as our "Distinguished Advocate." This year’s Distinguished Advocate is Morgan Chu of Los Angeles, who will be on campus on Wednesday, February 1, 2006. Mr. Chu has served as lead trial counsel in winning some of the largest verdicts in California history for disputes involving complex patent and technology issues. All students and faculty are invited to meet and hear Mr. Chu at the following events:

On Monday, February 13 at 12:00 Noon in the Panelli Moot Court Room, a faculty panel will moot Kent Richland of Los Angeles, who is representing Anna Nicole Smith in the case of Marshall v. Marshall before the U.S. Supreme Court. This case presents the Court with the continuing validity of the "probate exception" to federal jurisdiction. Students are welcome to observe the moot. Copies of the briefs are available in the law library.

Remember that you MUST schedule an appointment through the following methods in order to receive or review your exams and papers. If you do not have an appointment, then your exam will not be ready and you might be asked to schedule an appointment for a later date. Please plan accordingly.

An important message from SCU's Information Technology Department:
We are currently experiencing major problems with email to/from the Internet. SCU is currently the target of the latest Internet email virus/worm (w32/sober-aa). We are seeing a increase of greater than 1000% in email volume with all of that being invalid and infected emails. This huge volume is causing tremendous problems for the systems involved in delivering Internet messages resulting in delays and possible loss of messages.
We are working with our vendors to minimize the effects of these virus generated emails. As we have updated information, we will be posting on our IT status page located at http://it.scu.edu.
