Our colleagues at USF noticed a recent decision issued by the 9th Circuit in which the court chastises the defense counsel for failing to properly research the relevant case law. The case, United States v. Beltran-Moreno, was appealed even though the sentences given were below the mandatory minimum. The court admonished the defense counsel for bringing the appeal, stating that they subjected their client to an increase, not a decrease, in the sentence given. It is yet another example of the vital importance of legal research.
