N.J. Supreme Court Ruling in Favor of Rutgers Law Clinic

Here is a link to Sussex Commons Associates, LLC v. Rutgers, today’s decision from the New Jersey Supreme Court concluding that the Rutgers Environmental Litigation Clinic is not required to disclose client-related documents, clinical case files, or information about the development and management of litigation. In so holding, the Court overturned a 2010 Appellate Division decision (416 N.J.Super. 537, 6 A.3d 983) which had found Rutgers University, the law school, and the law clinic subject to New Jersey’s Open Public Records Act (N.J.S.A. 47:1A-1 to -13). The Appellate Division decision had been a matter of concern to public law schools in New Jersey and beyond because of the important role law clinics play in legal education today.
