In a videotaped interview of Mathew Zeidenberg and the lawyer who represented him in the case, conducted several years after the decision, Zeidenberg and his lawyer indicate that ProCD's statement of its return policy was buried near the end of the 70+ page user manual and that ProCD really didn't have the return policy described in the manual.
