n10 The dissent is undoubtedly correct that at least some home buyers may not understand what "merchantability," as opposed to "quality," means. But the use of the term "merchantability" in this disclaimer, mandated by Commercial Code section 2316, when coupled with the explicit exclusion of every other form of implied warranty, as well as any claim not covered by KB Home's written warranty, could not possibly mislead a reasonable new home buyer as to the scope of the waiver intended.
