A few paragraphs earlier in the opinion, the court tells us that on the morning after being awarded the contract, plaintiff stopped at the defendant's office and first met defendant's construction engineer. The court then quotes this testimony of the plaintiff: "I introduced myself and he immediately told me that they had made a mistake in their bid to me the night before, they couldn't do it for the price they had bid, and I told him I would expect him to carry through with their original bid because I had used it in compiling my bid and the job was being awarded them (emphasis added) ." What would your analysis be if plaintiff's testimony had been: "I introduced myself and I immediately told him that I had stopped by to let them know we got the contract and that we would be using them for the paving and he told me that they had made a mistake in their bid to me the night before and couldn't do it for the price they had bid." How well do you think the parties to the conversation remembered exactly what each had said and in what order?
