The enforceability of reaffirmation agreements is governed by Bankr. Code 524(c) and (d), supplemented by any applicable state law (such as state law providing that such agreements are enforceable notwithstanding the common law contract rule governing pre-existing duty). In these materials we do not explore the requirements for an enforceable reaffirmation agreement.
