Secured parties will often hire independent contractors to undertake repossession rather than train in-house personnel.  See the website of Automobile Recovery, a Houston area repossession company, for an example.  Case law generally holds secured parties liable for a breach of the peace committed by an independent contractor.  Accordingly, a secured party will typically require that the independent contractor insure against claims of breach of the peace.   J. Braucher, The Repo Code: A Study of Adjustment to Uncertainty in Commercial Law, 75 Wash. U.L.Q. 549, 560-66 (Spring 1997).

Repossessors may be the subject of extensive statutory or administrative regulation.  See, e.g., regulation in the California Business and Professions Code, and a portion of the website of the California Bureau of Security and Investigative Services of the California State Department of Consumer Affairs.
